Arguing about hookers being legal in TJ

Nothing if he declared it. He can actually bring 50 units/pills without a prescription of any lower scheduled drug. If say they found it in a cursury search I doubt theyed proscute although technically illegal if not declared. Thats if you are a US citizen. Would be much different though were you a foreigner. I've seen customs go after little old ladies and their meds that were bought legally over the counter in their home country. Actually asked the customs guy that was searching me(used to it-been thru customs mor times than i can count) if that was a regular occurance and he said yep-every day. That was LAX however,and air travel entry is slightly different these days. Was coming back from SEA where prostittution is also illegal but tolerated. I will say that the customs guys are pretty cool here, compared to the dicks in So FLA.

If they found it, then I would have been in trouble, been offered a plea for misdemeanor possession, and let go with no jail time. But they wouldn't have found the Viagra at the border or on the US side. In the US they need probable cause to search, and they wouldn't have gone to the deep pockets of my wallet to find a single pill if they found nothing on the rest of my body.

Iam so sorry to heat your stories... Yes, TJ cops are so corrupt.
That is not the same story here in Monterrey... it is a totally different story, but I've had my run-ins with the local LE, but being a local and knowing quite well all procedures and what scares them, allows me to know how to act.
For example... the Viagra pill. I wouldn't care about that one, I know you would (by the way sirs... just tell me what would happen if they find Viagra on you while corssing the border??? On the USA side, you need to carry a prescription too...)
And yes, the best way to avoid that kind of problems is going to TJ with friends, never alone. TJ has changed A LOT. It isn't that safe as it looks and it isn't as friendly with tourist as it appears.
So take care when ever you go down there....

It takes more than that MrDiviner. I am a respectable gringo, but it didn't matter. The TJ cops are crooked. It should also be said to never walk alone in TJ. A year ago, I got rolled by the TJ cops a couple of blocks up the hill from the alley behind Adelitas. For no reason other than I was walking by myself, they had me up against the wall with my legs spread, and they inspected every inch of me from inside my shoes to inside my wallet. They found half of a Viagra that I hid in my wallet a few hours earlier. They threw me in the back of their car and circled around the same blocks a dozen times or so until I got the hint they wanted $100 from me before they would let me go. It isn't like it took me that long to figure out what they wanted, but I wanted to see how far they would go before I gave them the money. I have not been back since.

Of course it illegal but to the laymen most places don't seriously enforce it so its not "really" *wink, wink* illegal. My advice is do not get drunk (I suggest not drinking period), do not carry weapons, do not have sex in public and respect the police and the locals. A respectable gringo that shows the locals he is ok never has problems as far as I know.

As for underage prostitution they are on the streets for sure do not even thinbk about it for that they will bust you, if they don't the US government can! That I have seen some idiot in TJ picked up a 13 year old they gave him a choice a Mexican prison or a US Prison for child abuse and other charges. Stick to the bars at least the girls are checked and all as far as I know is over 18.

It is nice to hear from a rational voice. I am also a licensed attorney (member of the California State bar) though i admit i do not practice International law either. You make a good point, Mr. Divine. But, the point is that this guy was telling newbies that it is illegal. I'm sure that you will agree, counsel, that there is a world of difference between an activity being illegal and one that is regulated and not officially banned or sanctioned. Prostitution is not technically legalized in many places on Earth.

However. illegal means literally "forbidden by law; contrary to the law." This is false information. In Mexico (as in most countries where legalized prostitution is found) there is no legal endorsement or ban of prostitution, one way or the other. It is regulated in 18 states in Mexico, including the state he was referring to. This is a form of legalization (regulated but not officially banned or sanctioned, like in Amsterdam). Sir Isaac Newton's laws of gravity are not guaranteed either, but I would place about as much chance on getting busted in TJ for picking up a hooker as in the forces of gravity reversing themselves.

I would advise anyone who visits TJ to keep a few dollars in reserve to bribe a cop. The cops are corrupt and like to shake down tourists for bribes every chance they get. Which again supports my argument, because were there any question regarding the legality of our activities in TJ, customers in Zona Rosa would be getting shaken down for picking up hookers as a fairly common occurrence.

It is actually an absurd concept. I have been to TJ at least 20- 30 times a year for the last 12 years (you do the math) and have never even heard of a bust, not once. But I have seen the police enforce the regulations by checking girls health cards in AB and on the streets. It is regulated and officially does not exist, and is, therefore, not illegal as this individual has asserted. he went so far as to talk of customers paying fines, etc.. Bullshit.

You may get shaken down by the cops in TJ, but that is not going to happen to you for picking up the girls and is most likely to come into play if you are driving in TJ (police favorite) or for jaywalking, spitting on the sidewalk or being drunk in public.

I'm a lawyer and although not my field I do practice International Law. There is a common law principle which simply means: "A law that is on the books but ignored by the state (as in government) is a de facto non-law." Simply the fact they refuse to seriously enforce the law means that its not legal or illegal but in general a gray area.

I personally keep a $20 bill to donate to the local policia charity of the officers choice if they do notice me but I don't drink much, do drugs or carry a weapon and go straight to and from AB or the CC by taxi, traveling generally early over late. So am usually pretty safe.

Prostitution is NOT legal in Mexico. It is a misdemeanor at worst, fineable up to 450 pesos in my State.
To regulate in Mexico means that the municipios or counties for you, include within their norms of operation, rules that monitor and regulate prostitution, but that doesn't mean that they are doing it base on a law that says in Mexico prostitution is legal.
Again: in Mexico, prostitution is tolerated... only tolerated.
