A male babysitter has been found guilty of sexually interfering with the young daughter of a friend in several incidents starting when she was 4. Benjamin Phillips, 71, showed no reaction when Ontario Superior Court Justice Faye McWatt called his denials of the repeated incidents unbelievable.

“It’s hard to prove you’re innocent,” the retired building superintendent told The Star as he left the University Ave. courthouse Monday. “It never happened.”
But McWatt convicted him of sexual assault, sexual interference and invitation to sexual touching with respect to six incidents starting in 1993 when the girl, the daughter of his friend, was 4.

The incidents involved fondling and kisses, and him exposing himself but not intercourse. Five incidents occurred in her mother’s home. One happened in his Scarborough apartment. The victim testified that he warned her: “Don’t tell your mother.”


She told prosecutor Kosta Stratos said she knew what he was doing was wrong but was too confused and afraid to tell her mother, McWatt said.
“She was embarrassed and scared about what Mr. Phillips had done and she wanted to forget it,” the judge said.

But she said the attacks continued to haunt her through high school and university.
When the victim was at university she got counselling, and that resulted in the incidents being reported, the judge said.

“I believe her,” the judge said, calling the victim highly intelligent and with “a remarkable memory.” The victim’s mother testified that when she found out she confronted Phillips, calling him a “filthy pig and child molester,” but he denied the incidents occurred or, alternatively said the perpetrator might have been someone else. No other man had babysat the victim.

The mother testified that she was furious, telling him he would burn in hell, and he replied “I know. ”The judge found this to be tantamount to a confession, though he would later phone and leave a message saying: “No little bitch is going to ruin” his good name, the judge said.

He also made veiled threats, telling the mother he had spies in her neighbourhood, the judge said. Phillips, a divorced father of three, took the stand in his defence, denying that the incidents occurred, or alternately that a friend, now deceased, may have been responsible for at least one of the incidents.

“I find Mr. Phillips’ evidence unbelievable,” the judge said. He remains out of jail and returns for sentencing June 27.
