Board of Massage Therapy rules against Marco Island business - Marco News

The Florida Board of Massage Therapy fined and temporarily suspended the license of a Marco Island business earlier this month after it failed to meet background screening requirements set by the state.

The board’s Aug. 13 final order found in favor of the Department of Health, which filed the administrative complaint in September 2017, and issued a $1,000 fine to Angel Nail and Spa of Marco Island, LLC. The board issued suspension was issued until the business met the state requirements.

State law requires people with an ownership interest in businesses with more than $250,000 in assets to submit fingerprints to a vendor approved by the Department of Law Enforcement. The board’s order included violations of two statutes.

Angel Nail and Spa of Marco Island, located at 599 S. Collier Blvd., did not attend an April 2018 public hearing or contest the factual allegations according to court documents.

“Since the licensee has not replied to the Administrative Complaint nor contested the factual allegations, the prosecuting attorney offered the investigative file to prove the facts as alleged,” the final order states. “The investigative file was received into evidence and the Board finds the uncontested facts adequately support the allegations.”

Angel Nail and Spa did not respond to a request for comment.

In its administrative complaint, the Department of Health sought one or more of the following penalties: permanent revocation or suspension of license, restriction of practice, imposition of an administrative fine, issuance of a reprimand, placement of the respondent on probation, corrective action and continuing education and/or relief deemed appropriate by the board.

Angel Nail and Spa was also required to pay $33.50 in investigative costs in addition to the fine within 90 days.
