ABMP ran an article recently on Gift Card/Certificate laws by state. I thought this would be helpful information to share. Here's the summary:
These states allow any expiration you choose, as long as it's clearly disclosed:
Arizona, Georgia, Nebraska, Nevada, New York, Texas, Utah, Virginia
These states don't allow any expiration date whatsoever:
California, Connecticut, Florida, Maine, Minnesota, Montana, Oregon, Rhode Island, Washington
Gift certificates must be honored for one year:
Kentucky
Two years:
Arkansas, Hawaii, New Jersey, Ohio, Tennessee
Three years:
Vermont
Four years:
Maryland
Five years:
Illinois, Kansas, Louisiana, Michigan, New Mexico, Oklahoma
Six years:
North Dakota
Seven years:
Massachusetts
Miscellaneous Extra Rules:
โข New Hampshire: no expiration for cards of $100 or less.
โข South Carolina: may not expire for one year unless expiration date is capitalized in 10-point font on front of card
If your state isn't listed:
Then the law for your state doesn't contain specific language regarding expiration dates.
