Good mileage and insurance receipt: is it possible?

I recently went to a massage place where I got HJ. After the session, the lady asked me if I needed a receipt. I took it, but once outside the building I got rid of it, cause I thought I could eventually have problems with the insurance company (and possibly LE and my employer) if they found out that this receipt was issued by a place that offers some sort of mileage.

Have you had experience with insurance companies investigating about a receipt issued by a MP? Do insurance companies have a "black list" of MPs? Do they really care about what happens between the customer and the SP? In a sense, I did get the relaxing benefit of the massage, but could the insurance company argue that I got it in a possibly illegal context? On the legal aspect, can it be considered like fraud? And how to make sure that the receipt is issued by a therapist who is allowed to do so?

What are your thoughts on this? Thanks in advance!

First, there is the moral aspect of offloading such expenses on other insurance clients.

Second, with everything on computers these days, any claim you submit will basically be in their system "forever". Do you really want that?

Third, it is not a "possibly illegal context". Bawdy houses are illegal in Canada, plain and simple, no exception.

No they are not.

There was a judgment a year or two back where the judge ruled
that masturbation is a therapeutic ending to a full massage.
It was talked about on this very forum, if you perform a search.

You cannot rely on such a case from a very low level judge. I've previously posted links to very recent cases where a low level Laval judge found that lap dance clubs are essentially illegal. Low level court decisions have little or no precedent value.

Until a Superior court (or ideally an Appeal's court or SCC) rules otherwise, you are taking a real risk.

But if you have the money to defend yourself in court, I encourage you to keep doing it because I really would like to see a well litigated case rule on this issue definitely.

My contention is that there is no such thing as a legit massage place in Canada that offers HJ, since that instantly makes it a bawdy house.

The odds that you will get caught are low. You may even get away with fraudulently charging your insurance company for HJs for a while. But make no mistake, you are playing with fire.

Just remember, don't do the crime if you can't do the time.

Obviously, I would never submit a claim for services provided by a place which openly advertises as a MP offering extras, but I agree with SuperIntendantChalmers, there must be some good looking ligit therapists who like to have fun with their customers? It doesn't make the legit part of the massage less beneficial? But then, how do you know if the therapist at l'Ovarium is willing to offer this kind of service? Or how would she communicate to the customer that she can offer this service without risking to lose her job?

As for the "moral aspect of offloading such expenses on other insurance clients", I had not thought about it, I think it's a fair point, I would not like to see my premiums increase to pay for these activities (unless such service was formally covered by the insurance policy, which is unlikely). However, if only the legit part of the session is claimed, then I don't see any problem there. It's like people who claim for the radio that they did not have in their car before the car was stolen, that to me is fraud. But if your car is stolen and the insurance company pays for a new car, there's nothing bad in paying an extra to the dealer to get an upgraded radio, as long as you don't claim it.

first of all any recepeit or anything like this is confedential and if ever it is known the insurenace company will be sued...Second of all the insurance company decide to pay or not to pay....The receipt that usually you give them is for the massage part.....And all the massage place that offer receipt does stop at massage only if you insisit not a problem....So you don't put in the receipt whatever option if you take one...

If the receipt is issued from a recognized association then thereshould be no problem. In this market of high competition, even the memebers of insurance recognized associations have to offer attractive service to stay in business.

If a place is able to give receipt that means it is legit place and NEVER the insurance company will tell the company well this employee goes to the this place or this place....even if there is something like a fraud wuth receipt the insurance would just come back to you and ask for reimboursment that is all.
The only you will be in trouble if you are their when there is a raid ,the same way if there is a raid on a Strip bar.. you could go to legi tplace and get reseipt and you never know that this place does something else...So you culd accpet receit if it is given...It is complety confedential and safe

I am a massotherapist, and i can tell you they shouldn t give you receipt because they don t have an association, like FQM, AMOC, CIMA are different kind of association whose working with insurance companies and actualy these (Massage Parlour) is illegal to give receipt, to give a receipt you need to have an association if not ... Illegal, this is an order to protec their therapist and workers. If they continue to give the receipt then ( the place could pay an ticket (amende) over 2000$ to 10 000$ ... We are fighting against this kind of massage to gain our unique title as Massotherapy Certified.

First of all, a disclaimer: I'm not condoning fraudulent charges to your insurance company, but here's my take on it.

If the MP is certified by one of the recognized associations, there should be no problem. A couple of points to remember:

1) An insurance company can either accept or refuse a claim. They have no right to tell your employer/wife/mother/father/priest/cousin about the medical services that you've claimed. That is confidential information. Check your policy's privacy statement for more info;

2) Check your insurance policy. Some insurance companies will pay out claims that are supported by receipts from MPs that are members of one of the official associations. As long as you are given a receipt for a massage that falls within your policy, you should be able to claim it;

3) Even if the insurance company is concerned with the nature of the services rendered, there is no way for it to actually prove that you got something beyond a massage.

So I'll just close on this thought: medical expenses and tax files are supposed to be private but they get fully revealed if criminal proceedings are filed against you!

I know several masseuses that offer insurance recognized receipts, the massage portion is paid for by the insurance company, but the happy ending provided becuase I tip in addition to the receipt amount. The massage and happy ending become two separate matters.

Your example is REALLY not equivalent!!

See, you get a receipt for the massage for which you paid, and anything else is really a separate transaction, be it legal or otherwise. Insurance companies have clear rules on what receipts can and can't be accepted; you're not breaking the law by submitting a receipt for a massage, regardless of what happened after the massage, as long as it conforms to those rules. The rule is usually that the massotherapist must certified in the province that he or she practices in.

An example of an illegal situation similar to the above would be getting receipts for massages that never happened, or for different amounts than actually paid. THAT would indeed be considered fraud.
