I knew something stunk about cities licensing MP's. And I finally figured it out! The licencing of massage parlours is illegal. The municipalities are really licensing criminal activity. They grant massage parlours licences with full knowledge of the prostitution activities that occur inside them.
They thought they found a legal loophole by granting licences with a warning in 'fine print' saying, 'No masmassageplanet.netation services.' But, this 'fine print' would provide a weak defense in a criminal trial. The law is concerned with substance, not form. The municipalities have, with full knowledge, (requiste intent) abetted (encouraged) the commission of criminal activity in massage parlours by granting them licences, that they knew, would be used to commit criminal activity.
The municipalities are thus found guilty as parties to the offence (bawdy house provisions) for abetting the commission of criminal offences. [read s.21(1)(c) in conjunction with s.210 of the Criminal Code] They abetted violations of s.210 of the Criminal Code through their creation of licenced massage parlours. They had full knowledge that their licences would be used for the primary purpose of committing criminal acitivity.
