just want to vent about something at my job

I have been debating about leaving my job. I am a Physical therapy tech at a small PT clinic. I also do 20 minute massages on all the patients. I have worked there for five years as a physical therapy tech doing ultrasound and some of the machines. About a year and a half I have had my own massage business and I use one of the rooms at the clinic. I do this two afternoons a week which has been great. I work full time as a tech and part time at my business. In the past my boss offered me health insurance but years later she stopped b/c she couldnt afford it. She recently joined a corporation and told us that this meant we may get more benefits such as health insurance, or 401k. Now we arent eligible for a 401k because they said we are to small of a clinic. I was told in the beginning that I may get health insurance. I found out that today I am not eligible for health insurance because I am only a tech and they cant get me health insurance under the job descriptions of Tech or MT. This was their company's policy, that techs dont get insurance. But they thought that at the beginning I could get it because of being a massage therapist and helping out at the front desk. I do so much more though than just my tech job : helping at the front desk, doing laundry, ordering supplies, and doing medical records. I was only part time at both jobs before and now they put me as full time, but I dont get any benefits or anything. I work about 38-40 hours there and do 2-4 hours of massages on those other days. I guess I am just mad because it was offered to me and now I cant have it. I really want to leave because I feel unappreciated. My boss just told me that she thinks that there is some law saying that your employer is required by law to give you health insurance if you work 30 hours or more. Well, if that is the case why didnt she offer me insurance always?
Have any of you heard of a law that says that? I was just wondering.

She is a partner with this guy who told me I cant get the insurance. Why couldnt she just talk to him instead of me keeping on asking him? I dont want to leave because my business is there and she dropped my rent charge for the room. On the other hand I dont enjoy the other job so much anymore, they doublebook PT patients sometimes and then they complain to me about what they did to schedule them that way! It makes no sense. I am sorry that you've been frustrated by all this on again off again benefits talk that your employer keeps dangling in front of you.
To my knowledge a company does not have to offer health insurance to you unless they have a certain number of employees. If your clinic is now part of a corporation, the total number of employees of the entire corporation should be considered... not just your particular "branch." However, many times corporations do have a minimum requirement that must be worked, of 30 hours per week, in order to be eligible to get insurance.
I've known some people whose employer carried such crappy health insurance that it seemed to them that it would be better to have none. But I guess that's another issue entirely.
If you are seeking insurance benefits, I would recommend you find out about the corporation who has purchased the clinic where you work... and then try to get an appointment with someone in human resources who can explain the company's requirements to you. Only there do I feel you will get the definitive answer you seek.

Health insurance may be mandatory

Companies cannot discriminate on who gets health insurance and who does not based on their job description.

If you are a statutory employee and insurance is offered to all employees, then it has to be offered to you.

However, the employer can put certain restrictions - such as you must be FT (and they define the # of hours), how long you have to be with the company to qualify etc.

Health Insurance companies require that X% of employees participate in the plan and that the employer pay Y% or more of the premium.

Yeah actually the human resource guy said that he thought that I could get insurance, but later because of my job description the ceo of the company said I cant. He said if I was a front desk person that I could get insurance though. Before we joined the corporation, I worked at the desk and as a tech along with calling insurance and lots more. But R&R is right, the CEO can NOT legally refuse to insure you, if the company does carry insurance for full-time employees and you are a full-time employee. It doesn't matter what your position is or isn't. What matters is you are full time and they have group insurance available. The CEO doesn't outrank law.

I'd either find another job, or go nose-to-nose with the guy and let him know that this is required by law and will be provided....or the law will be invoked. (That said, I honestly would go get another job!)

I talked to my boss again and just stated my frustration and tried to be firm about the whole thing. She said she would call him up and talk to him because she was very frustrated too about all this confusion. I would talk to him face to face but he is in the corporate office one hour away and is always in a meeting. In the mean time I will fight it and still look for another job. I am applying online to alot of places in the health care centers, hospitals, etc, but no one seems to be hiring. Massage Envy is hiring but I am not sure how that place works yet. Thankyou for that bit of info. I may not want to even apply there after reading some of that stuff. I may look at some other PT clinics in the area or at a hospital nearby! Thanks guys! I will let you know if anything else happens. I talked to my boss again to asked her if she got a hold of the CEO guy. Maybe I will find out info from Eqaul opportunity Employer.
