A Longmont massage therapist was formally charged with two felonies Friday after he was accused of sexually assaulting a client during a massage.
Daniel Robert Avalos-Vigil, 30, faces one count of sexual assault false medical exam and one count of sexual assault overcoming a victim's will. He was arrested Wednesday and posted $7,500 bond the same day, according to the Boulder County District Attorney's Office.
A preliminary hearing was set for 2:30 p.m. Dec. 15 at the Boulder County Justice Center.
According to an arrest affidavit, the victim told police Avalos-Vigil would "bump against her genitals" while he was working on her hip at Massage Envy, 210 Ken Pratt Blvd., and the most recent time was Oct. 1.
She said she had been a client of Avalos-Vigil about a dozen times over the last two years "because she was a runner and he gave good athletic massages."
She said he had touched her sexually in the past, but thought then it was accidental. She said when she asked him why he this time he penetrated her with his finger, he responded that he didn't know why and then apologized.
A medical exam showed the woman had a small abrasion where she said he penetrated her during the massage.
When police talked to Avalos-Vigil, he said he was working on her upper adductor and not paying attention when he touched her. He said he was running late that day, was too tired and too comfortable touching someone's adductor.
