Despite being acquitted of criminal charges by a jury in March, a Longmont massage therapist accused of inappropriately touching a client has relinquished his license to practice massage therapy in Colorado.
Daniel Avalos-Vigil voluntarily gave up his massage therapy license effective April 16, according to state documents.
According to an arrest affidavit, a female client of two years told police Avalos-Vigil would "bump against her genitals" while he was working on her hip at Massage Envy, 210 Ken Pratt Blvd. She said he digitally penetrated her on Oct. 1.
When police talked to Avalos-Vigil, he said he was working on her upper adductor muscle and not paying attention when he touched her. He said he was running late that day, was too tired and too comfortable touching someone's adductor.
Avalos-Vigil, 30, was found not guilty of two counts of sexual assault in relation to the allegations. But in a separate proceeding, the Colorado Department of Regulatory Agency's Division of Professions and Occupations ruled Avalos-Vigil "engaged in an act or acts that failed to meet the generally accepted standards of massage therapy care."
While the ruling acknowledges Avalos-Vigil maintains the contact was accidental, the department ruled that he "failed to utilize proper draping technique" and that "there was no therapeutic purpose" for him to touch the client's genital area.

By voluntarily relinquishing the license, Avalos-Vigil waives his right to a hearing on the matter and is no longer allowed to practice massage therapy in Colorado.
Avalos-Vigil's attorney did not immediately respond to requests for comment on Wednesday.
