A judge has sentenced a North York mother who fatally beat her 2-year-old daughter to 6 years in prison. After time for pre trial custody, she must serve 4 years and nine months more. Ontario Superior Court Justice Nola Garton imposed the sentence on the 34-year-old woman Wednesday afternoon.

On Jan. 17, Garton found Erika Mendieta guilty of manslaughter in her daughter Emmily Lucas’ death seven years ago. She had been charged with second-degree murder.
Crown prosecutor Allison MacPherson had called for a 10-year term. MacPherson asked for the 10 years to denounce Mendieta’s crime, noting that the mother of six singled out the-34-month old girl for prolonged beatings, leaving little of her body unmarked.

In a fit of frustration on Nov. 13, 2003, Mendieta beat the girl unconscious, severely injuring her head and spine, the judge found. The tot died in hospital 10 days later.
Mendieta lied to paramedics and doctors about how Emmily was hurt — claiming she had fallen down some stairs -- thus hampering their efforts to save her, MacPherson said.

But defence lawyer Bob Richardson, noting that Mendieta is a first offender and herself had been abused both as a child and, later, as a spouse, asked the judge to impose a four- to six-year sentence. Wednesday’s sentencing is a final step in a case marked by controversy. Mendieta’s first trial ended with a hung jury in 2009 after her former common-law husband, Johnny Bermudez, stunned the court by testifying he was the real killer.

Her second trial ended in another mistrial last November after the jury and Mendieta complained that a prosecutor formerly working on the case was distracting them by making faces as he sat among the spectators.

The trial continued in front of Garton without a jury.
