Good day everyone.

A coworker and I have come up with a possible business venture. He has a basement which can be rearranged into a massage room and I would be the therapist and charge a certain amount per massage, and give him a portion of it. However, I am worried that we have not solved all legal issues to begin this.

We were thinking about advertising online on websites such as craigslist, backpage, facebook, and such other online and social networking sites. I know this may probably sound sleazy to people, but I would include pictures of myself, the room, the house, and maybe a few shots of the neighborhood, and also include my certification number so any potential clients know that I am certified and have the ability to look it up online and see. Also I would stress that the service would be professional therapeutic massage.

First of all we reside in the state of Maryland and while I have achieved national certification(NCETMB), I did not take the Maryland State Jurisprudence Examination. Does this alone disqualify my from this plan?

Second of all, neither of us has a business license and I'm not sure whether or not he has a zoning permit.

A few items to think about... if you think it sounds sleazy... to anyone... don't do it. Clients may feel the same. You don't want to unnecessarily ruin what could be your "good name" as an MT. You want to be known as a professional on all levels.

If you didn't take the Maryland state jurisprudence exam and you are required to, then that would be a problem. Here is your old thread about that. I read the following: "All applicants shall successfully take and pass the Board Jurisprudence Examination to qualify for licensure or registration." Did you ever contact the schools to find a class, test prep or study guide for that test?

Last, if the city requires a zoning permit, you will need to get one. That is your responsibility to find out what is required to set up practice. Again, if you do not, then you risk being known as unprofessional. If you don't abide by the known laws, you risk being shut down and a black mark would definitely be attached to your "good name".

Hi pueppi. I did call my school regarding the Jurisprudence examination. I have all of my papers together except one last page, which did not arrive in the mail in time for me to take the test this year. Since the deadline for getting the papers in is the first of every month, and the test is only available once a month, I can't take the November test, and there is none offered in December.

So unfortunately I can't work as a MT in Maryland until at least late January. Regarding the contents of the test, my school told me to study the ethics chapter of my textbook and that it's really just a dumb easy test that nobody ever really fails, basically.

I am going to take your advice and not advertise on craigslist or backpage, but if we go through with this, we will still use facebook and twitter. Those websites are not sleazy in my opinion.

Otherwise if I can find employment in Virginia or DC, that will be great. Thanks for your response.

pueppi, I have just called the board to ask if I could. Not only did the lady say no, but she was quite derogatory as well and according to her, I will not be able to take the November exam, so I will have to wait until January.

She did give me another person's number so hopefully that person will be helpful if she calls back. Apparently I will be the token idiot of this industry if I ever manage to get in.
