Just wondering what services are usually provided when the therapist pays 30% of each massage monthly?  Laundry, etc.?  If therapist were asked to pay 40%, what services are included by owner of office?  Is there a formula for what is offered by the owner at different perceneforum.xxxes?  Thank you for your help.  I have seen posts on this but not all together, sorry for my confusion.LeContefairy

when i worked in a day spa, the spilt was 50/50. i was responsible to clean and stock the massage room and when there was enough linen for a load of sheets or towels, i was to put them in the washer/dryer and fold them as well.when i worked in a major resort spa, mt's were paid 30% of the fee. (70% to the house) in that environment, you can expect to straighten and restock the massage room, assist guests in any way, but otherwise, your hands are all you need.just some examples.hope it helps

Did the large spa take any taxes out on you?  I am guessing the large spa did scheduling for you, how about the day spa?  Did they schedule for you?  I recently talked to a therapist who is being paid 40% of the total.  The day spa schedules her appointments, provides oils and sheets, does all advertising, she only has to show up.  My question to you and everyone is:  at what point do you stop being a contract employee and become an employee where the spa pays taxes on you etc.?  What are the laws on this?Thank you, just interested in fairness and laws.LeContefairy

Laws vary from state to state.If you become and emp, you $/service will drop to the point your employer is providing little benefit beyond handling your taxes - your bottom line is the same. As an emp., you lose the right to deduct certain expenses - like mileage - you get as an IC.

yes, fairy, they both handled the schedule.each job was an interesting experience, i was busy in both places and i learned alot.now i own/operate my own gig, that's the best for me.  ;D

If the therapist is getting 70% of the service cost, they should probably provide their own equipment, linens, lotions, etc. How are you doing the monthly charge? Are you paying THEM monthly or are they responsible for keeping up with how much they make and paying you at the end of the month? What we did at the school I worked at was basically a weekly paycheck. All payments went to the school, and the school would cut the therapists a check every Monday. Maybe this would make it easier, and make sure both parties get paid what they're supposed to?

I thought that would make her an employee instead of contract labor since she does not have anything to deduct for taxes, it seems the day spa is getting by with collecting 60% and not paying any taxes for her.  Is this pretty standard?You answered my question Seforum.xxxg if the therapist pays 30% of the gross they are responsible for pretty much everything. Some (not all, thank god) business owners will pay as little as they can get away with period. Then they sit around and wonder why they have so much turn over and can't get good employees! Well Duh!!Sorry, a little grumpy this morning.

I found this article online. This is a VERY BASIC definition for what defines an Independant Contractor vs. Employee, posted by the Texas Workforce Commission.

Control need not actually be exercised; rather, if the service recipient has the right to control, employment may be shown."

I think your friend is getting a pretty good deal. While she may not be able to write off much when it comes to tax time, she also doesn't have to report as much income, so she's really not missing out. By not getting paid that money that she would have spent on those items anyway, it just means it's less for her to have to keep up with. But yes, that's pretty standard to not make her an employee. In fact, I really don't know MANY massage therapists that ARE employees; most are independant contractors.
