My guess would be for posting the video. I don't believe a store/mall is allowed to release surveillance video and allow them to go viral. She's a ditz but she might have a claim. I would love to hear from our residence lawyers on this one.

when you watch the video you can tell it was captured by a cell phone while viewing the security footage.

I would say the guards on duty are in trouble.

Maybe she has no case at all, but Geraldo is talking about the fountain being unsafe...sounds absurd

but he had a point when he said that if she sues the company running the mall might settle for 25k rather than pay 50k defending a frivilous suit.

Thats whats wrong with the system.

Happens even here, I was on a condo board, the association was sued because some little kid picked up a stone and dropped it on the other kids foot, while playing where they shouldnt have been anyways. The insurance company paid out (less our deductible) to make it go away. Not much mind you like 1200-2800 or something. Lawyer probably got half.

The mall should counter-sue for the costs involved to clean up the water she is dripping all over the floor and for the cost to drain, clean and refill the fountain. Who knows what contaniments she introduced to the water by illegally bathing in a public fountain. :he:

The janitor should also sue her for the mental stress and anguish caused by the extra work he/she needed to do. :tongue:

This just plays up to our "not my fault for my own stupidity" society. People sue McDOnald's because they got fat eating fatty foods, and yes, the fountain didn't have a 6' fence around it. Should it? No. Legally? Yes. Say good bye to all the little pleasantries in life if this is the case.

There is such a thing as common sense, then there's the legal sense. Never the twain shall meet.

(btw, but she does look like a bit of a 'tard doesn't she?)

The real issue here isn't the fact that the video on youtube embarrassed her, it is the fact that her own stupidity embarrassed her.....let's not mix that up......If she wasn't so stupid the video would have shown a woman walking in a mall...BFD......

Actually I spoke to the owner of a Tim Hortons who told me that she was totally justified. Supposedly the coffee makers have a tendency to "creep up" the temperature of the coffee and the unit at that particular McDonalds was set way too high.
Its like your water heater in your house. You CAN set it well into the danger zone but they recommend that you do not. I personally have mine set at the maximum (160 I believe) I use less Hot water and more cold!

well apparently she has some outstanding warrants or something about using some elses credit card, so maybe she should have kept her tv appearances to utobe and not interviews.

She will probably roll this whole thing into an appearance on Dancing with the Stars or Americas got Talent(isnt she graceful Mabel hard to believ its that fountain woman)....followed by a Debut Album(featuring snoop dog)..guest appearances on Oprah where she reveals her years of suffering as a txt addict....then comes the book...and finally the movie deal....oh sorry then rehab (where she rooms with lilo)...and start the process over again!

Dude: you're wasting energy. Sure you're using less hot water but you're using more energy to make it and keep it hot. No matter how efficient the new w/h's are, there is still thermal loss.

It would be better to set it lower and use less cold water. That way, you're not using as much energy to heat the water and then keep it hot.

Put it another way: you spent all that energy to get it really hot, then you use cold water to bring it down to a comfortable level....

Kind of like paying extra for 151 proof rum, then leaving the cap off so the extra alcohol (which you paid extra for) evaporate because it's too strong.....
