Anyone ever had a malpractice claim

I hate to be the suspicious type, but it sounds like she might be one of those sue-happy people. I'd do a little sleuthing and see if you can find out if she has a history of suing HCPs.

Sorry to hear about your situation, Nancy. It's the kind of thing that leaves me a bit nervous, getting into a biz where claims are so easily made and rather difficult to disprove. Sounds like you're doing all the right things.

Not to completely derail this conversation, but I wonder if anyone else is concerned about having facts about perceneforum.xxxes and amounts rewarded in lawsuits posted here for any person with less-than-ethical intentions to have easy access to. I'm sure the info could be found elsewhere, but the fact that it is here, on a board that is so connected with massage just seems to me to be making it too easy. Just a thought.

If I was a less than ethical person and found those figures, I'd think "pah! not much point going after a massage therapist - the average pay out is less than $5000" though I am sure some others would think because it is such a small amount, it would probably be easier to get.

Back to the main topic, I find the comment "She said she wanted to get it handled before Thanksgiving" really bizarre - how on earth anything involving so much paperwork could be handled in such a short timeframe????? I think you might not hear from her again because you DO have insurance - maybe she goes around trying to find therapists with no insurance whom she can semi-blackmail with the threat of having to go to court about the issue? eg "I've lost 4 days work, but OK now, you cover the 4 days and I won't take it any further" and maybe some get scared enough to go along with it.....

I agree -- it certainly made me wonder why she would say such a thing. That statement sounds like a possible threat of extortion, almost a hopeful "Pay me now and it won't cost you as much as it would if we walk down the liability claims path."

I'm curious if the person who referred her to you has any idea what she brought to your life?
