if he was just joking then any of those icons would have conveyed such a sentiment. the embarrassment icon is insulting/condescending in that context. Either he is embarrased because "he knows" (implies we do not) the "Canadian" law or "we do not know" (implication is we are uneducated on the matter, but somehow he is an expert on the issues). The true punch line is THEN he then puts up erroneous information for others to rely on.

so i just answered with the same tone and showed the "misinformation" and some errors of his "learned" interpretation.

after all, I DON'T want any eforum.xxx dudes operating under misapprehensions of the law. personally, i don't think a person deserves thanks for putting up legally incorrect info (especially when it involves potential criminal offences)

While I can't locate the cite there was a Superior Court case, in Ontario or Quebec where the court held that it was not public where the solicitation was in a secluded area even though it was a public street, but it was clear there was an expectation of privacy by the remote area the road was in.

Otherwise I agree with you. I was correcting the original poster who had a lot of wrong information. I will stand by mine.

In the Montreal strip club case the Canadian Supreme Court ruled that there was no bawdy house violation by breast touching or other contact as long as there was no penetration of masturbation.

Yes you can advertise in newspapers for sex if its an indepedent outcall escort it is not solicitation. It would not be wise for an agency or incall for other reasons than solicitation. Related to solicitation, It is not a public "place" which has to be a physical space like a street or common area of a hotel etc. There is nothing wrong with ads for sex in newspapers, websites etc in Canada at least criminally. It may be against the policy of a newspaper but its not illegal.

For the past decade on many Canadian board going back to the old pre massageplanet.net/eforum.xxx/eforum.xxx, Canada Best etc it was amazing to me how many Canadians thought prostitution was illegal in Canada. That is what I was referring to not any particular Canadian here.

There is a gal in Phoenix who moved here from Edmonton, who insists I am totally off base because she knows that prostitution itself in all forms is just illegal in Canada. She was told this by a lawyer and police officer friend. I offerred to phone the lawyer and straight out what I assume was a misunderstanding. When people think "prostitution" they usually think of street hookers, which of course is illegal (solicitation) in Canada, but not prostitution itself as so many Canadians believe.

There is one case where a street hooker told an undercover cop that she couldn't discuss anything on the street but to come to her nearby hotel room. He busted her for solicitation. The judge said she knew the law better than the cop and dismissed the case.
