Licencing restrictions for out call

In school we are currently in our business module and the subject of licencing restrictions came up. We discussed that even though we will be getting a commonwealth of VA licence we will only be able to see clients in the county in which we are licenced to practice which means (especially for outcall) if they have a client in the next county over they will need to go through the process of getting licenced in that area along with paying the fee of $75-125 before they can see that client. Is this correct? And for this reason do most of you who do outcall stick to local area clients only. This law seems very limiting. Is there a way to get a wavier per client for outside counties?

It depends...

Virginia is a funny place.

Every county sets its own rules and some might have a "visiting" provision.

Also, in VA, so long as you don't call yourself a "CERTIFIED MASSAGE THERAPIST" the state Board of Nursing has no jurisdiction over what you do, how you do it or where you do it.

Some county's laws are linked to certification, others are not.

Wow, your state has strange rules. I was always under the impression that if a state passed a licensing law it overrode the county laws. Obviously, I was wrong. Anyway, I've gotta ask: how would anyone know you were doing outcalls in another county? It's not like setting up business in another county with an actual office that might get someone's attention. I know the school has to tell you the law, but when the law's ridiculous, I wonder how many people actually follow it.

In the same vein, FL says you have to have a county occupational license to operate a business. It's just $30-40 so not much of a big deal, but in some instances you have to have a CITY occupational license too. Oh, and if you do outcalls in a surrounding county... you have to have one for each of those counties too. :roll:

just like plummers and electricians. though sometimes the people issuing these don't get the 'out-call' part, and want to stick with an establishment occupational license..
i seem to always have to say, "no, i'm like a plummer, i have my gear in my house, but i only 'plumb' at the homes of my clients." :banghead:

The problem is, the state law is a "certification" not a licensure law.

Subtle but important difference. Certifications are optional, licenses are mandatory.

Down towards the end of this ridiculous ordinance states:
"

No part of any quarters of any massage, bodywork or somatic therapy establishment shall be used for or connected with any bedroom or sleeping quarters, nor shall any person sleep in such massage, bodywork or somatic therapy establishment except for limited periods incidental to and directly related to a massage, bodywork or somatic therapy treatment or bath. This provision shall not preclude the location of a massage, bodywork or somatic therapy establishment in separate quarters of a building housing a hotel or other separate businesses or club or residence if same has been approved by the zoning department or granted a variance by the Franklin Township Zoning Board of Adjustment.

"

This reads to me that we cannot do massage at a clients home.

I might have missed something 'cuz I didn't read the whole law, but...

I'd still see a grey area for outcalls, but maybe it's because I'm coming from a FL perspective. Here, a massage *establishment* has a specific massage establishment license. Outcalls don't require an establishment license. What is the technical designation of a "massage establishment" in this case?

And anyway, how transparent is transparent? Do they have a meter to measure how much light passes thru like they do for window tint? :roll:

To me it read/meant:
Say I was doing massage in the neighboring county-middlesex. I get clients referred by that client who reside in Franklin. I cannot give them massage in their home. I assume they have bedrooms in their homes.
It was all so ridiculous when they inacted it a few years ago. They bantered back and forth on a lot of the language. I was surprised to see that the transparent clothing was still in there.
The flat out not allowing me to go to outcalls wouldn't matter in this case because of the bedroom scenario.


There are some other down right silly comments regarding minors.

to me those provisions appear to be directed to outlawing a home studio as a place of business rather than proscribing outcalls.
The term "establishment" would not apply to a home you visited.
