On a coroner’s report after the death of a man reported on Friday October 22, 2010. After a 911 call, ambulance, fire department and crime scene investigation arrived at the drama site. A man, in his early forties rest lying on the sidewalk with blood coming out of his nose and his head. Ambulance technicians reported the death of this man upon their arrival. During the investigation process, CSI took thorough pictures, around the scene, interrogated several witnesses and ordered an autopsy. The death was reported to be caused by that man tripping over and fell and his head crashed against a rock next to the side walk of the National Bank, on Dorval Avenue. After the conclusion of the autopsy, detectives have more evidences to create back the death scene. Two key elements of the investigation that led to an arrest were:
a) The man had a National Bank teller machine receipt in his pocket for a withdrawal of 160$ one hour and ten minutes preceding his death plus a ten dollar bill in his pocket, and,
b) Biological DNA retrieved in his hair that belongs to the accused.
Combining all the reports, the crown prosecutor proceed to the arrest of a masseuse working at Spa Luna that bears the name of Anika. Her charge under Quebec’s Provincial law was criminal negligence causing death. She kept her right of silence and issued no interview to the detectives. After a non-guilty plea, Anika was set to be free without any restrictions, except giving massages until court hearing.
During the trial, Anika was cross examined thoroughly by the crown prosecutor and defense. The integral part or the constituent of whole trial was the two facts that the crown presented. Money was withdrawn from the deceased account and Anika’s DNA was found in the deceased hair. Excerpt of the court case below.
Crown prosecutor: Miss Anika, did you or did you not give a massage to the deceased?
Accused: Yes Sir, I did.
Crown: From the evidence gathered, he withdrawn 160$ and had 10$ left in his pocket, how much he tipped you?
Accused: Well, counselor, if you do the math, 50$ is the door fee for an hour and the rest he tipped me. So do the math yourself.
Crown: That makes it 100$ from my calculations. Why would he keep 10$ then?
Accused: The only assumption I could make, he was probably hungry and was bound for lunch. It was around lunch time that he left me from my memory, 12:15 pm roughly.
Crown: Ok, that clears the money issue. Now, please tell the court how your DNA could get stuck in his hair? Please tell this court from start to finish of his hour with you.
Defense: Objection!!! Your Seigniory, this is private matter that happened behind closed door. This remains private and confidential.
Judge: Please proceed with the answer.
Accused: I’m very embarrassed to tell what happened in the room. This is private matter.
Judge: Miss, this is a court order to answer to the Crown’s question, last warning.
Accused: Ok then. I greeted him with a huge smile. It was the day after my birthday and I was still in the birthday week mood. I spoke to him and he even pointed out to me he knew me from my days at the loft with Aby. My memory got refreshed and remembered immediately who he was.
